The firm has significant experience representing buyers, sellers, landlords and tenants in real estate transactions. This involves the sale, lease, and development of residential, commercial, industrial and mixed-use properties.
All too often real estate transactions can be taken for granted as routine easy matters. While they may be common, there are significant legal, financial and tax issues involved in buying, selling and leasing real estate. For many individuals, and businesses, it represents the largest dollar transactions that they may ever get involved with. For that reason it is imperative that individuals and businesses have good legal advice and a strong negotiator to help protect them and their interests whatever the real estate transaction is.
Our firm provides practical skilled guidance to clients buying or selling residential, commercial, industrial and mixed-use properties. Every real estate transaction is different and has its own set of issues. Some of the issues are known up front and others can only discovered after the contract is signed. For example, in a purchase, how should title be taken: in individual names, in trust or through an LLC? Because of this we listen to our clients and ask many questions to be sure that we understand the situation and their goals. We also educate them on the process and to also understand their options. This allows us to give counsel to help protect clients from the known risks and hopefully many of the unknown risks as well. We can then review, negotiate and close the real estate transaction to match the client’s goals and interests.
In addition to the more traditional real estate acquisition and disposition we also help those individuals and businesses looking to do a like-kind exchange (1031 exchange). This allows for the disposal of a property and the acquisition of another without creating a current tax liability. Like-kind exchanges can be a mine-field of requirements for the unwary, and we help our clients navigate this mine-field to achieve the desired tax outcome.
For years owners and renters have relied on our firm for advice in all aspects of the landlord and tenant relationship. This includes the drafting, review, and negotiation of lease agreements for commercial, residential, industrial and mixed-use properties.
Often, there are also important tax, business, and/or estate planning considerations in a real estate transaction. Since our firm practice areas cover all of these considerations we are uniquely positioned to provide guidance on how clients can best align themselves to their goals in these areas.
We have relationships with outstanding real estate agents, lenders, insurance agents, inspectors and appraisers to help round-out the team that may be required to complete the transaction.
We want you to have a positive experience with your real estate transaction. We are dedicated to providing you the personalized and experienced legal services to help you achieve your broader goals through your residential, commercial, industrial and mixed use real estate transactions.
